Planning enforcement successfully shuts down illegal waste dump site

Farmland in Aylesbury being used illegally to deposit waste materials has been returned to its former purpose following enforcement action by Buckinghamshire Council.

An Enforcement Notice was served on the owner of Marsh Farm in Shabbington, Aylesbury, following an investigation that found the land, designated for agricultural use only, was being used for the importation and deposit of waste materials.

Under the terms of the notice, which was issued in March, the landowner was required to stop further use of the land for importing and depositing waste. They were also required to remove all existing waste material from the site and restore the land to a state suitable for agriculture.

The council’s planning enforcement team liaised with the landowners planning agent to ensure the order was complied with. This has now happened and the case in closed.

Gary Hall, Deputy Cabinet Member for Planning and Regeneration (Enforcement) said: “Planning enforcement is here for a reason. When a property or site is given a designated purpose under planning law, it cannot simply be overridden by landlords or owners without a proper legal process or the correct permissions being granted. This case is a clear example of how we deal with those who feel it is okay to ignore these laws and do what they want.”
